2 <br /> At the conclusion of the Division's June 17, 1993 inspection, the <br /> operator was instructed to do some earthwork in order to improve <br /> drainage from the lowest portion of the area in question. At that <br /> time, there was a flat stretch in the ditch at the toe of the hill <br /> which was not adequately draining water. A Field Minor Revision <br /> (number 38) was issued which approved construction of an additional <br /> diversion across the face of the borrow area. This ditch was to <br /> intercept surface runoff and runoff from a few seeps before it <br /> reached the bottom of the hill. Prior to the end of the <br /> inspection, the operator had also excavated the ditch at the toe of <br /> the hill so that water was flowing away from the area and toward a <br /> sediment pond. <br /> At the time of the July 7, 1993 inspection, the drainage from the <br /> lower ditch was considerably better than it had been prior to the <br /> June 17 inspection. However, there was still a low-lying area with <br /> marginal drainage. A second Field Minor Revision (number 39) was <br /> issued during the later inspection which allowed excavation of <br /> additional borrow material to be used to further improve drainage <br /> from the low lying area. During the July 22 , 1993 follow-up <br /> inspection this was verified by observing that adequate ditches had <br /> been installed and positive drainage had been established. <br /> In order to fulfill the requirements of the Field Minor Revisions, <br /> the operator was required to submit permit replacement pages which <br /> detail the final configuration of the area. These pages were <br /> received by the Division on July 20, 1993, and are currently being <br /> reviewed. <br /> Issue 2 of the TDN alleges a violation of Rule 4.05.2 (1) for <br /> failure to pass disturbed area drainage through a sediment pond. <br /> The area cited is the west end of the same topsoil borrow area <br /> cited in issue 1 of this TDN. <br /> Subsequent to the inspection, the operator implemented the plans <br /> approved in Field Minor Revision No. 39 which was issued during the <br /> inspection. This work involved establishing a new grade across the <br /> toe of the borrow area to improve drainage from the area near a <br /> seep. As a result of this work, surface runoff from the entire <br /> area, except a small portion of the borrow area (NW corner) , goes <br /> to a sediment pond. The drainage from the small area drains to a <br /> gravel filter, through a straw bale filter and will be sampled to <br /> demonstrate compliance. The alternative sediment control specifics <br /> have been submitted and are being reviewed. This was verified <br /> during a reinspection of the site on July 22, 1993 . At that time, <br /> there was no violation of Rule 4. 05. 2 . Therefore, no enforcement <br /> action is being taken on this issue. <br />
