This letter serves as the Division's response to the <br /> four issues cited in the TDN. Copies of all enforcement and <br /> permitting actions referenced in this letter are enclosed for your <br /> reference. <br /> Issue 1 of the TDN alleges a violation of Rule 4. 14. 1 (2) for <br /> failure to backfill an area to eliminate depressions. The area <br /> cited is at the toe of a topsoil borrow area adjacent to the Old <br /> Refuse Pile. This area collects surface water runoff from the <br /> topsoil borrow area and a portion of the refuse pile. <br /> The area cited was used to acquire cover material for a portion of <br /> the refuse pile. The area has not yet been reclaimed. It will be <br /> reclaimed in conjunction with reclamation of the final portion of <br /> the refuse pile. Backfilling and grading operations were not <br /> accomplished because topsoil removal was the only site activity. <br /> Therefore, the regulation cited in the TDN is not applicable to <br /> this area. There is no violation of Rule 4 . 14 . 1 because the area <br /> has not been backfilled and graded. <br /> It should be noted that the Division identified a concern with <br /> drainage from the area cited in the TDN during its June 17, 1993 <br /> inspection. The concern is related to questions about the <br /> potential stability of the foundation upon which the refuse pile is <br /> situated. The operator was required to do some field work to <br /> improve drainage from the area cited in the TDN. The work was <br /> approved by means of a Field Minor Revision to insure that concerns <br /> were addressed as expeditiously as possible. <br />
