r <br /> 2 <br /> As I indicated during the inspection, a previously issued NOV was <br /> also modified to address the need to protect the slope below the <br /> old refuse pile from further encroachment by Dutch Creek. Thus, <br /> four actions have been taken by the Division regarding the drainage <br /> and stability of the old refuse pile. These are: <br /> 1. NOV C-93-096 cites failure to assure the foundation of <br /> the refuse pile is stable. Abatement requires moving the <br /> channel of Dutch Creek away from the slope below the pile and <br /> armoring the''toe of that slope. <br /> 2. NOV C-93-096 also cites failure to maintain the 100-year <br /> diversion around the refuse pile. Abatement requires <br /> extension of the ditch to route all upland runoff around the <br /> pile. <br /> 3 . Field Minor Revision No. 38 allowed for the establishment <br /> of two defined channels to insure positive drainage of the <br /> area at the toe of the topsoil borrow area adjacent to the <br /> refuse pile. <br /> 4 . Field Minor Revision No. 39 allowed for salvage of fill <br /> material from an additional area to be used to further improve <br /> drainage from the topsoil borrow area adjacent to the refuse <br /> pile. <br /> The Division believes that the four actions above will adequately <br /> address drainage and stability concerns which have been identified <br /> during recent inspections.
