QPPSMENT of TyF
TAKES
yo United States Department of the Interior AWRECNA..
 a
OFFICE OF SURFACE MINING
MgRCH 3 e9 Reclamation and Enforcement
Suite 1200 IN REPLY REFER To
505 Marquette Avenue N.W
Albuquerque,New Mexico 87102
January 5, 1994
Mr. Steven G. Renner, Coal Program Supervisor
Division of Minerals and Geology
Department of Natural Resources
215 Centennial Building _
1313 Sherman Street
Denver, Colorado 80203
Re: Review of Response to Ten-Day Notice #93-020-244-003, TV-1; Coal Basin
Mines; Mid-Continent Resources, Inc.
Dear Mr. Renner:
In accordance with 30 CFR 842.11, the following is a written finding regarding the
Division of Minerals and Geology's (DMG) response to the above Ten-Day Notice
(TDN):
Violation 1 of 1 of the TDN was issued in response to a citizen's complaint for the
operator's failure to reclaim the haul roads and access roads on the entire mine in
a contemporaneous manner.
DMG responded to the TDN by indicating that enforcement actions NOV 93-109
and CO-93-144 have been issued to Mid-Continent Resources to address the
matter.
The AFO finds the DMG response with regard to violation 1 of 1 of the TDN to
constitute appropriate action. AFO will continue to monitor the disposition of the
State NOV and CO to ensure that the basis for AFO's finding is substantiated.
If you have any comments regarding this matter, please call Stephen Rathbun at
(505) 766-1486.
Sincerely,
Robert . n, Direc c
Albuqu que ield 0;,,-
