The TDN is for an alleged <br /> violation of Colorado Rule 4 . 13 which.- requires contemporaneous <br /> reclamation of coal mine disturbance. The TDN was issued as a <br /> result of a citizen complaint by Mr. Mike Mechau which was <br /> apparently received by the Albuquerque Field Office (AFO) on <br /> December 7, 1993 . This letter serves as DMG's response to the TDN. <br /> The Colorado Mined Land Reclamation Board set a compliance schedule <br /> for Mid-Continent Resources (MCR) in a May, 1991 Board Order which <br /> included a reclamation time table for the Coal Basin Mines. <br /> Subsequently, the Board ordered the permit revoked in August, 1992 <br /> and the bond forfeited in September, 1993 . <br /> On June 17, 1993, the DMG issued NOV C-93-109 to Mid-Continent <br /> Resources for failure to reclaim the mine in a contemporaneous <br /> manner. Abatement of the NOV was set at October 21, 1993 . Because <br /> the NOV had not been abated, a Failure-to-Abate Cessation Order <br /> (CO-93-144) was issued to MCR on November 2 , 1993 . Copies of the <br /> NOV and the CO are enclosed for your reference. The appeal process <br /> for these enforcement actions has not yet been completed. <br /> In summary, DMG has already issued enforcement actions for the <br /> violation addressed in the TDN. We feel this is an appropriate <br /> response to the TDN. <br />
