You have requested that the Division extends the abatement deadline of the <br /> violation until November 12, 1993. The rationale for the extension is that Mid-Continent <br /> Resources has requested that Federal Bankruptcy Court grant Delaney and Balcomb, P.C. a <br /> broader scope of representation for resources pertaining to citations or Notices of <br /> Violation. <br /> The Rules for Coal Mining at 5.03.2(2)(c) describe specific reasons under which an <br /> abatement period may be extended past the 90-day time frame. The Division has once <br /> extended the abatement by 30 days in accordance with this rule. The extension was <br /> granted because the Division was reviewing the permitting action submitted by <br /> Mid-Continent Resources, and had forwarded an adequacy letter to the operator. This <br /> extension expired on October 30, 1993. <br /> Mid-Continent Resources has not responded to the adequacy concerns of the Division. <br /> The reasons cited in your correspondence of November 3, 1993 requesting further <br /> extension do not coincide with the allowable circumstances for extension. Therefore, I <br /> must deny your request. <br /> I understand that the Division delivered to Ms. Diane Delaney a Failure to Abate Cessation <br /> Order on November 2, 1993. 1 would suggest that Mid-Continent take whatever steps are <br /> necessary to abate that Cessation Order and the underlying violation. <br /> Please contact Steven Renner of my staff if you have questions or comments. <br /> Sincere' <br /> Michael B. ong <br /> Director <br /> ,CC: Steven Renner <br /> M:\novmidc <br />
