STATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Natural Resources voF comer
1313 Sherman St.,Room 215
Denver,CO 80203 * +
Phone:(303)866-3567 1876
FAX.(303)832-8106
Roy Romer
Governor
Michael B.Long
November 3, 1992 Division Director
Mr. Edward Mulhall
Delaney and Balcomb, P.C.
Drawer 790
Glenwood Springs, Colorado 81602 X,
RE: Notice of Violation C-93-108
Dear Mr. Mulhall:
The Division has reviewed your request for extension of the above-referenced Notice of
Violation. You have requested that the Division extends the abatement deadline of the
violation until November 12, 1993. The rationale for the extension is that Mid-Continent
Resources has requested that Federal Bankruptcy Court grant Delaney and Balcomb, P.C. a
broader scope of representation for resources pertaining to citations or Notices of
Violation.
The Rules for Coal Mining at 5.03.2(2)(c) describe specific reasons under which an
abatement period may be extended past the 90-day time frame. The Division has once
extended the abatement by 30 days in accordance with this rule. The extension was
granted because the Division was reviewing the permitting action submitted by
Mid-Continent Resources, and had forwarded an adequacy letter to the operator. This
extension expired on October 30, 1993.
Mid-Continent Resources has not responded to the adequacy concerns of the Division.
The reasons cited in your correspondence of November 3, 1993 requesting further
extension do not coincide with the allowable circumstances for extension. Therefore, I
must deny your request.
I understand that the Division delivered to Ms. Diane Delaney a Failure to Abate Cessation
Order on November 2, 1993. 1 would suggest that Mid-Continent take whatever steps are
necessary to abate that Cessation Order and the underlying violation.
Please contact Steven Renner of my staff if you have questions or comments.
Sincere'
Michael B. ong
Director
,CC: Steven Renner
M:\novmidc
