This issue was raised as a result of the June <br /> 14-18, 1993 OSM oversight inspection at the Coal Basin Mine. This <br /> issue was originally one of four items in Ten-Day Notice X-93-02- <br /> 352-006 TV4. After an initial appeal DMG decided to issue an <br /> enforcement action based on the May 1991 settlement agreement which <br /> laid out a reclamation schedule for completing various tasks at the <br /> mine. The operator has failed to keep pace with the schedule and <br /> therefore the violation was issued. Enclosed for your review is a <br /> copy of the settlement agreement and reclamation schedule along <br /> with the Ten-Day Notice and related correspondence. <br /> A secondary issue was the failure of the operator to reclaim a <br /> small portion of haul/access road that was abandoned after a flood <br /> event washed out a culvert crossing Coal Creek near the five mine <br /> portals. DMG had issued a revision allowing the operator to utilize <br /> a low water crossing instead of replacing the culvert since the <br /> road had been downgraded to an access road from a haul road. There <br /> was no mention of reclaiming the road within any specified deadline <br /> in the revision. However, during the inspection the issue was <br /> raised and eventually appeared in the TDN mentioned above. Since <br /> this appears to be a contemporaneous reclamation issue it was added <br /> to NOV C-93-109 . <br /> This concludes my comments on these topics.
