• describe the probable cause of the violation(s) at 010 on May 3, 1984;
• describe the pond maintenance activities you have undertaken at 010 from
the end of the 1983 spring runoff event until May 3, 1984;
There is a provision in your permit pertaining to effluent limits in the event
of a storm in excess of a 10 year-24 hour event. Eligibility for such limits
requires that 1) the entity provide documentation that greater than a 10 year-
24 hour storm event has occurred and 2) the entity has complied with the
permit requirement whereby the size of a 10 year-24 year hour event, the
volume of runoff from such an event and the gauge station information be
supplied within 90 days of the effective date of the permit, which was
December 6, 1983 in your case. (See Part I.A.3, page 4 of your amended
permit. ) Cur records indicate that the information required by December 6,
1983 was not submitted, hence you are ineligible for limits as set out under
Part I.A.2.c. of the permit. If your record of submittals to the division
indicates otherwise, please include copies of the submittals in your response
to this letter.
Feel free to call me if you wish to discuss this matter further.
Sincerely, J
Sandy Squire
Engineering Technician
Permits and Enforcement Section
WATER QUALITY CONTROL DIVISION
xc : Jim Herron, Mined Land Reclamation Division
Permits Section, Environmental Protection Agency
Jerry Biberstine, D.E. , Field Services and Monitoring Section, WQCD
Ginny Torrez, Permits and Enforcement Section, WQCD
SAS/dkg
