• �k��� 6�T 2 5 <br /> -33- <br /> NOV C-84-106 <br /> Mid-Continent Resources, Inc. <br /> I. FINDING OF VIOLATION <br /> During the records inspection which took place during the May, 1984 <br /> inspection of Mid-Continent Resources, it was discovered that the <br /> operator failed to permit several temporary impoundments and a drainage <br /> ditch. It appears that the operator obtained a mining and reclamation <br /> permit without submitting the required designs for these water control <br /> structures. This is an administrative violation. It represents a <br /> technical deficiency in the permit. It also is a technical violation <br /> of the law. The Director finds that the violation occurred, and NOV <br /> C-84-106 is upheld. <br /> II . PENALTY ASSESSMENT <br /> The Division recommended a $50.00 assessment for history, a $50.00 <br /> assessment for seriousness, and a $250.00 assessment for fault. During <br /> the conference, representatives of the Division offered that they felt <br /> this violation posed a minimal obstruction to enforcement. This is an <br /> administrative violation in so far as it represents a technical <br /> deficiency in the permit. However, the Division was aware of the <br /> structures and had a historical knowledge of their functioning <br /> capabilities. No civil penalty assessment for this violation. <br />
