Based on the PR -9 application, TC is requesting an increase of 560 permit area acres and <br />500 affected area acres in the Western Mining District. Under the Western Mining <br />District heading of approved page 2.01 -4, 3,620 is identified as the amount of affected <br />area added and 1,013 is identified as the amount of permit area added due to the WMD. <br />The PR -9 proposed page 2.01 -4 identifies 3,650 affected area and 1,335 permit area. <br />There appears to be a discrepancy in the total amounts of acreage associated with the <br />WMD. Please discuss the discrepancy in affected and permit area acres associated <br />with the PR -9 application as to why 560 acres is not added to 1,035 and 500 added to <br />3,620. <br />3. Proposed page 2.05 -15 identifies coal ownership within the Life of Mine permit <br />boundary. The proposed page does not identify Stuckey, et alas a coal owner. However, <br />proposed Map 2 does identify Stuckey et al as a coal owner within the proposed revised <br />permit area. Please update the proposed section 2.03.4 (6) to include all owners of <br />record within the permit boundary. <br />4. Proposed pages 2.03 -33.3 and 2.03 -33.4 identify Federal Coal Lease COC -72980 as <br />being modified as of September 2012, Federal Coal Lease Application as being filed <br />August 2012, and a lease pending with David and Linda Male. Please provide the <br />Division with the following: a copy of the modified Federal Coal Lease COC- 72980; <br />a copy of the Federal Coal Lease application, and the coal lease with David and <br />Linda Male. <br />5. Proposed page 2.04 -9.1 omits discussion on the Peabody Sage Creek Mine overland <br />conveyor, 15LT Rock Dust Tank, 16LT Utility Borehole, 2011 -2012 Exploration, and <br />2012 WMD Exploration as found on approved page 2.04 -9.1. Please provide an <br />updated proposed page 2.04 -9.1 to include omitted required information. <br />
