General Limitations -Active and Post-Minine Outfalls 1) There shall be no discharge of sanitary wastewaters from taileu or related facilities. 2) There shall be no dischazge of floating solids or visible foam in other than [race amounts. 3) There shall be no land application of wastewater other than for dust control. 4) No chemicals shall be added to the dischazge unless specific approval is granted by the Division d. Burden of Proof Requirements The pertnittce has the bttrdrn of proof when requesting relief from total suspended solids (TSS), total iron and/or settleable solids limitations. Relief shall be granted only when necessary and shall not be granted whrn the permittce has control over the discharge. The permittce should endeavor [o meet the primary limitations whenever possible. The Division shall have final authority in determining whether relief is granted. 1) For rainfall, to waive TSS and total iron limitations, it is necessary to demonstrate that dischazge occurred within 48 boon after measurable precipitation has stopped. To waive settleable solids limitations, it is necessary to prove that dischazge occurred within 48 hours after precipitation grearer than the 10-yeaz, 24-hour event has stopped. 2) For snowmelt, to waive TSS and total iron limitations, it is necessary to demonstrate that dischazge occurred within 48 hotus after pond inflow has stopped. To waive settleable solids limitations, it is necessary to prove that discharge occurred within 48 hoots after pond inflow volume greater thau the 10-yeaz, 24-hoar event has stopped. The Division shall determine the adequacy of proof. As part of this determination, the Division shall • evaluate whether the permittce could have wnrrotled the discharge in such a manner that primary limitations could have been met. All manual dewateriag of ponds that are equipped with automatic dewazermg systems must meet TSS and total iron limitations. If a pond has only manual dewatering capability, relief is available only to the extent required to regain necessary stability and capacity. See Part I.C. for Definitions
