October 6, 2012 MINOR REVISION REQUEST — MINOR REVISON NO. 58 (MR -58) Energy Fuels Coal, Inc. - Southfield Mine — Permit No. C -81 -014 115 East Main St, Florence, CO 81226 Phone 719 784 6395 Fax 719 784 6395 Energy Fuels Coal, Inc. (EFCI) respectfully requests approval of this submittal for Minor Revision No.58 (MR -58). The revision pertains to the mitigation plan to backfill and reclaim six old subsidence holes located at the former (abandoned) Canon Nation Mine site. The site is located in the SE1 /4 of Section 25, R7OW, T2OS of the 6 Meridian. The site is located within EFCI's permit boundaries. Owner of the property is The Corley Company of Colorado Springs, Colorado. The coordinates of the site are: 38 degrees, 17'01.63 "N, 105 degrees, 09'55.86 "W. A map, Subsidence Mitigation Map, depicting the location of the referenced site is included with this submittal. Additionally, a copy of a map generated by the DRMS' December 14, 2011 Inspection Report is included which depicts the relationship of the subsidence features and mine workings. Fill material: Fill material to backfill the subsidence holes will be used from the existing old spoils pile that was believed to be established during the former operations of the Canon National mine. The spoils pile is located adjacent to the subsidence holes. The estimated volume of fill material (compacted) required is approximately 600 cubic yards. Fill material transport: The fill material is located adjacent and close to the subsidence holes. Given the short transport distance, a rubber tired front end loader will be used to shuttle the fill material from the spoils pile to each subsidence hole. Compaction: The fill material will be wheel compacted in 8 inch to 12 inch lifts during the backfilling process of each hole. Topsoil: Topsoil volume for the backfilled subsidence holes and the disturbed area created by removing fill from the spoils pile (footprint) is estimated to be 50 cubic yards. The topsoil intended for use is located at the contractor's property, Kessler Reclamation, 508 Twin Pines Ave., Rockvale, Colorado and will be truck hauled to the mitigation site. Prior to use, the topsoil will be sampled and analyzed for suitability according to the soil suitability criteria in the EFCI permit document. In the unlikely event that the topsoil is found to be unsuitable, either another source will be tested or an approved soil substitute growing medium will be used. Seed mix: The previously approved Table 33, Permanent Seed Mixture and Seeding Rates for the Corley property is included with this submittal. The exception to Table 33 is that the landowner, The Corley Company, has designated to omit the Fourwing Saltbush from the seed mix.
