The mine is intermittent in <br />operation on lands held by the Department of Energy (DOE). Operations <br />(intermittent or active) are currently pending as a result of the prohibition of <br />activity currently in effect for DOE leases. As such, all activity is prohibited until <br />the completion of the DOE's ongoing Preliminary Environmental Impact <br />Statement (PEIS) pertaining to DOE leased lands. In accordance with the <br />Division of Minerals, Reclamation and Mine Safety (DMRS) rules all uranium <br />mines are required to prepare an Environmental Protection Plan (EPP) which is <br />compliant with Rule 6.4.21 of the Hardrock Mining Rules. This EPP for the <br />Ellison Mine is designed in accordance with those Rules and Regulations. <br />A map depicting the location of storage and handling areas for potential toxic <br />materials; and the land surface and ground waters which have the potential to <br />be affected by the Ellison mining operation are depicted in Figure 1 below. At <br />the Ellison Mine the only material that will meet the definition of potential toxic <br />material is the future ore stockpile. The currently permitted Ellison Mine is <br />located approximately 1200 feet from the Dolores River and all future mining <br />activity is anticipated to be above the ground water table. <br />The DOE requires the facility meet DMRS reclamation requirements at the <br />conclusion of mining and it is expected the Pending PEIS may identify other <br />requirements which are not known at this time. At the time the Ellison Mine was <br />initially permitted the Colorado Department of Health and Environment had a <br />General Storm Water Permit for mining operation in the State of Colorado. <br />DRMS EPP requirements ask for a listing of "any air, water quality, solid and <br />hazardous waste, and other federal, state permits or local licenses, or other <br />formal authorizations which the Operator /Applicant holds or will be seeking <br />applicable to the use, handling, storage, or disposal of designated chemicals and <br />acid mine drainage- forming materials ". Since at the present time there are no <br />discharges from the Ellison Mine Adit and there are no surface facilities that <br />involve solid or hazardous waste these permitting needs are not applicable to the <br />Exhibit U -1 <br />
