NOSY 's C-88-021 and C-88-02 41 AY 1 ( 1988
3-
Dear Ms. Thompson,
Pursuant to Rule 5.04. 7 of the Mined Land Reclamation
Divisions Rules and Regulations Mid-Continent Resources
would lime to submit some information relevant to the above
mentioned NOV 's.
NOV C-88-02-1 was written under Regulation 4.+J3. '(6) (a) which
states that "light use road maintenance shall be sufficient
to ensure minimazation of erosion for the life of the road".
As we noticed during your inspection water was by-passing a
drainage culvert and flowing over an embankment. The action
of the water had caused a minor gully to form.
The area around the gull, is previously disturbed ground
near the overland conveyor_ No topsoil was present in the
area. The water that flowed down the embankment traveled no
more than -20 , before it was intercepted by the haulage road
ditch system.
After I became aware that the water was not flowing into the
culvert I had a crew member attempt to take a loader up the
light use road and re-establish the drainage. Because of the
wet road conditions the loader was unable to drive up the
road. Therefore, my entire crew went to the site and hand
dug a ditch to the culvert. The drainage was re-established
before the end of the shift. The gullies were filled in
today (it finally dried up enough so that the loader could
drive to the site) .
Erased upon the above facts Mid-Continent Resources feels
that the light use road has been maintained in such a manner
that erosion: has been kept to a minimum. Mid-Continent
respectfully requests that NOV C-88-0 1 be vacated since it
is our opinion that Rule 4.03.=:(6) (a) has not been violated.
