The Hoard finds that the bond is a deed of trust, to <br /> certain real property and that in order to obtain reclamation <br /> funds, a foreclosure action on the deed of trust and a stile of <br /> the property would be necessary. The Board at this time is not <br /> ordering that a foreclosure action be instituted. Consequently, <br /> the action of forfeiting the bond in this matter is not precluded <br /> by the automatic stay issued by the bankruptcy court. <br /> 7. Since no proceeds from the bond are available for <br /> reclamation purposes without a foreclosure action and sale, the <br /> forfeiture of the bond does not relieve MCR of its obligation to <br /> perform reclamation and maintenance of the site as previously <br /> ordered, in full compliance with the permit, the statute, and the <br /> regulations promulgated thereunder.
