26 <br /> 20 . FORMAL PUBLIC HEARING <br /> PITTSBURG & MIDWAY COAL MINING COMPANY File No.C-80-001 <br /> Edna Strip Mine. Staff distributed a package of information, <br /> including copies of the NOV package, an inspection report, <br /> maps, pictures and the operator June 30, 1993 request for <br /> formal review. This matter related to the operator' s request <br /> that the Board vacate NOV C-93-026. <br /> The Division inspected the site during the March 30 through <br /> April 1, 1993 inspection period. Staff referenced Rules <br /> 4.05 .5 (1) (c) and 4.05.5 (2) (c) and said this NOV was written <br /> for failure to design, construct and maintain sediment control <br /> measures to minimize erosion, as necessary, to provide <br /> protection for topsoil and vegetation and for failure to <br /> retain sediment within disturbed areas. The intent of the <br /> Regulation is to minimize offsite impacts using the best <br /> technology currently available to provide protection for <br /> topsoil and vegetation. <br /> The NOV applied to the Grizzly Pad facilities area, the east <br /> side of the upper facilities area and the outlet of Culvert E- <br /> 12 . An assessment conference was held and that the conveyor <br /> belt was modified out of the NOV during that meeting. <br /> Staff referenced the package of information and discussed the <br /> Grizzly Pad which measures about 300 feet by 400 feet of <br /> gravel and dirt surfacing. The area contains coal screens and <br /> a small coal stockpile, and is surrounded on three sides by <br /> reclaimed land. Staff said that drainage on the Grizzly Pad <br /> is usually controlled by a system of a berm and a ditch that <br /> route drainage back to the haul road, the entrance of the Pad <br /> and to the west ridge pond. <br /> Staff discussed the location of the areas included in the NOV. <br /> The upper facilities area measures about eight acres and is a <br /> dirt and gravel yard which houses the shop, offices, <br /> warehouse, maintenance shops and a coal stockpile. A at the <br /> time of the inspection, snow and coal material from the <br /> facilities yard had been pushed over the berm located on the <br /> east side of the facilities yard. The operator' s activity <br /> caused the material to be deposited on undisturbed areas where <br /> topsoil and vegetation had not been removed. <br /> Staff discussed the violation related to Culvert E-12 . At the <br /> time of the inspection, the culvert was plugged with coal <br /> fines and mud. Staff said that a slurry of mud and coal fines <br /> had flowed through the culvert and out onto reclaimed areas <br /> and that topsoil and vegetation was contaminated by the mud <br /> and the coal . <br /> Staff discussed the reclaimed areas on which the bond had been <br /> released and said the areas are now considered undisturbed. <br />
