Board Member Danni <br /> discussed a concern that the problem was not addressed during <br /> previous inspections by the Division. <br /> Mr. Long said that in the past, when votes have been tied, the <br /> Board re-voted or continued the matter to the next hearing and <br /> reheard the matter. Board Member Stewart said that if the <br /> matter was continued, it would be heard in its entirety or the <br /> absent Board Members would be asked to listen to the tapes <br /> prior to the next hearing. <br /> Mr. Paul stated that he would like for the Board to continue <br /> the matter to the October 1993 Board Meeting and for the <br /> absent Board Members to listen to the tapes of this hearing <br /> prior to the next hearing. FORMAL PUBLIC HEARING <br /> PITTSBURG & MIDWAY COAL MINING COMPANY File No.C-80-001 <br /> Edna Strip Mine. Ms. Cheryl Linden, the Assistant Attorney <br /> General, stated that the operator had made a request that this <br /> matter be continued to the October 1993 Board Meeting. She <br /> said that the Division would agree with the continuance, with <br /> the following conditions: 1) the operator will submit the <br /> technical revision by October 7, 1993, 2) the operator will <br /> complete the road, ditch and berms by October 31, 1993, as <br /> stated in the technical revision, if the weather permits. <br /> Staff clarified that the conditions for continuance are the <br /> requirements by the Division for abatement of the NOV. Staff <br /> said the matter will be addressed during the October 1993 <br /> Board Meeting, if an agreement has not been reached by that <br /> time. <br /> Mr. Dave Beverlin, an attorney representing the operator, <br /> stated that the technical revision has been submitted and the <br /> operator wants time to attempt to resolve the issues of the <br /> technical revision with the Division. <br /> The Board continued this Item to the October 1993 Board <br /> Meeting. <br />
