He said that at that time, Mr. Massey and <br /> Mr. Holden were informed of the Board' s position, regarding <br /> the bankruptcy, liquidations plans, etc. <br /> Mr. Long referenced the liquidation plan ATTACHMENT A, <br /> provided to the Board prior to this meeting, and said the <br /> operator' s representatives were present today to ask questions <br /> of the Board and to hear their specific concerns about the <br /> issues related to this matter. <br /> Board Member Danielson asked if the operator' s continued <br /> maintenance at the site was dependent upon whether Board <br /> agreed to the plan the operator had provided. Mr. Holden said <br /> the company' s position, as set forth in the plan, was to <br /> fully fund reclamation of the site. However, He' said that the <br /> plan does not contemplate interim reclamation. Mr. Danielson <br /> said that the plan is not acceptable to the Board and that the <br /> Board did not want this to cause interim site maintenance to <br /> be ceased. <br /> Ms. Delaney stated that the operator was not sure of the <br /> Board' s position, regarding the operator' s presence at the <br /> site. The Board explained that they wanted the operator to <br /> remain on the site and continue interim maintenance. <br /> Board Member Stewart briefly discussed the citizens' <br /> complaints that have been received related to reclamation, the <br /> bankruptcy filing; the operator' s presence 'on the site, etc. <br /> She said the Board does not want to continue to negotiate this <br /> matter with the operator, while reclamation is not being <br /> accomplished. <br /> Mr. Massey stated that the plan contemplates conducting the <br /> maximum amount of reclamation possible this summer with the <br /> assets available and minimize the requirement for site <br /> maintenance. <br /> Board Member Danielson said the Board would request release <br /> from the stay, in order to sell the rock dust plant 'as soon as <br /> possible. He said that the proceeds would be used to complete <br /> the reclamation possible and that the Board would pursue other <br /> avenues to obtain further reclamation funds. The consensus of <br /> the Board was that Mr. Danielson' s comments represented the <br /> Board' s current position, regarding this matter. <br /> In response to an inquiry from the Board, Mr. Holden stated <br /> that the bankruptcy proceedings would not interfere with the <br /> Board' s plans to foreclose on the rock dust plant and that the <br /> operator had planned to have a plan in place by April . <br />
