11 <br /> amending the Order of July 27, 1993, and asked that it be <br /> approved by the Board, in order to modify the current Board <br /> Order. <br /> Staff said the Board Order needed to be amended to allow the <br /> Board to hear the entire violation, which was not done during <br /> the July Board Meeting, and to correct the time frame from 45 <br /> days to 60 days for the posting of the bond. <br /> Mr. Paul Danio stated that he was present on behalf of the <br /> Joint Venture and that he had no problems with the <br /> modification to the Board Order. <br /> The Board amended the July 27, 1993 Board Order, as <br /> recommended by the Division. <br /> 7. FORMAL PUBLIC HEARING <br /> RAM ENTERPRISES File No. M-85-007 <br /> Staff distributed a package of information, including a <br /> presentation form, letters to the operator dated September 1 <br /> and 7, 1993, and a notice of this hearing. Staff said that <br /> this matter related to the operator' s request for confirmation <br /> of a previous permit approval. <br /> Staff said that the operator' s previous permit approval was <br /> granted on July 24, 1985, and that the operator did not <br /> provide performance or financial warranties within one <br /> calendar year of the approval . <br /> Staff referenced the September 7, 1993 letter and said that it <br /> contained a list of five items that should have been completed <br /> by the operator prior to this hearing. Staff said the items <br /> mostly related to notice requirements and a provision of proof <br /> of a current, legal right-to-enter. Staff said the Division <br /> has received all five items from the applicant and that they <br /> were deemed adequate, after review. <br /> Staff referenced the September 1, 1993 letter and said the <br /> Division reviewed the file and notified all of the objectors <br /> to the original permit approval by mail. Staff said the <br /> Division did not receive any objections to the current request <br /> for approval of the application. <br /> Staff explained that a change from the original permit <br /> approval included the lifting of the $5, 000 bond cap for <br /> limited impact permits. Staff said the bond for the proposed <br /> operation was recalculated and determined to be $13, 700 . <br /> Staff said that since the original approval, the haul road was <br /> also changed, at the request of some objectors, to route it <br /> away from the Pueblo Nature Center. <br />
