9 <br /> permit would require that a cyanide spill of any size be <br /> reported within 24-hours of the occurrence. <br /> Mr. Long, regarding quality assurance/quality provisions, <br /> stated that the operator had committed to retaining an <br /> engineer or consultant, chosen by the Division, to inspect and <br /> certify the heap leach pad during construction. <br /> Mr. Dager stated that he had no questions of the operator, <br /> regarding the remarks they made during their rebuttal <br /> testimony. <br /> During his rebuttal testimony, Mr. Dager presented the report <br /> on blast monitoring, dated August 18, 1993, which was prepared <br /> by Mike Rosenthal, the OSM representative. He presented a <br /> drawing which he said depicted the historic flow of water from <br /> the tunnels in area and discussed this issue, the need for <br /> monitoring and a study of the hydrology. <br /> Mr. Dager' s closing statement consisted of a brief discussion <br /> of the mining history in the area, including the potential <br /> impact to waste dumps from precipitation. <br /> Mr. Hardaway made the closing statement on behalf of the <br /> applicant. He stated that the operator is committed to <br /> proceeding in a technologically sound manner which protects <br /> the environment. <br /> Staff referenced the Division' s September 21, 1993 memo and <br /> recommended that the Board approve the applicant' s amendment <br /> application with the 20 conditions (listed in memo) to which <br /> Staff said the applicant had agreed and committed. Staff read <br /> the list of conditions from the memo, which included a <br /> provision for the submittal of the $13 million bond within 60 <br /> days of amendment approval . <br /> In reference to blasting, Staff presented an August 24, 1993 <br /> memo which summarized the Division' s technical review of the <br /> issue and the report prepared by Mr. Rosenthal, and discussed <br /> this matter with the Board. <br /> Board Member Stewart suggested that the applicant conduct a <br /> joint inspection, including sampling, of the Moffat Tunnel <br /> with Mr. Dager on a periodic basis. Mr. Hardaway stated that <br /> Mr. Dager is always notified of the applicant' s presence on <br /> the site and that they would not be opposed to conducting <br /> joint inspections. <br /> Board Member Danielson provided a list of five (5) suggested, <br /> additional conditions for approval of the amendment. <br />
