Lessee will replace the three existing stock ponds in their general existing locations <br />with existing sizes or larger as approved by the Division of Minerals and Geology. <br />Lessor will have exclusive right to any or all pastures on the Property for haying <br />and /or grazing purposes, when such operations are permitted by Colorado Division of Minerals & <br />Geology. <br />Lessee will maintain an irrigation ditch or a 4 -inch water pipeline to Lessor's house <br />located on 28454 2700 Road until the property is returned to Lessor. <br />5. Ste. Lessor represents and warrants to Lessee that Lessor has title to the Property <br />and Coal sufficient in extent and legal quality to grant to Lessee the leasehold estate and the Rights <br />specified in this Lease.
