■ <br />on the Lease Date, then such additional title or rights shall become, without further action of the <br />parties required, part of the transfer, leasehold estate and Rights granted hereunder, and the <br />amounts payable to Lessor, as stated in this Lease, shall also be in full consideration for all the <br />benefits secured by Lessee from such additional title or rights. <br />7. Other Mineral Interests Lessor covenants and agrees that after the lease date <br />Lessor shall not lease, convey or grant any other mineral interests or rights in the Parcel A or B <br />properties (including without limitation oil and gas) to any third party without the express inclusion <br />in such lease, conveyance or grant of a provision by which the rights of such third party are strictly <br />subject to and subordinate to those of Lessee. <br />o Operative P(OV ; Sions of This ': easo 1 tiffs Lease and Contract states the entire <br />agreement between the parties and replaces all oral and written representations, correspondence <br />and agreements. No amendment or modification of this Lease and Contract shall be binding unless <br />made by a written instrument executed by Lessor and Lessee and of equal formality. The terms and <br />benefits of this Lease and Contract shall accrue to and be binding on the successors, assigns, <br />sublessees, heirs, executors, and administrators of the Parties. All notices by Lessee to Lessor <br />hereunder shall be considered effective upon personal delivery or upon deposit in the U.S, mail, <br />postage prepaid, addressed to address stated herein. If there should be more than one party <br />designated as Lessor(s), notice shall be considered sufficient under this Lease if given personally <br />or mailed to any one of them. If and when requested by Lessee, Lessor shall execute a <br />Memorandum Lease so that Lessee may record same and give notice of the estate and rights <br />received under this Lease without, however, giving notice of the amount of the royalties and other <br />matters hereunder which Lessee considers confidential. Lessor shall not record this Lease. <br />If Lessee shall default in making any payment or in the performance of any obligation <br />hereunder, Lessor shall not be entitled to proceed with any legal remedy therefore unless and until <br />Lessor shall have first given written notice to Lessee of such default sent by certified mail, return <br />receipt requested, and shall have given the opportunity to Lessee to correct same within sixty (60) <br />days following receipt of such notice. <br />Lessor agrees to provide, to and for Lessee, consents to road relocations and closings and <br />any other consents, acknowledgements, affirmations, and waivers and relinquishments required by <br />present and /or future laws (which Lessor is legally capable of providing) to enable Lessee to <br />exercise its Rights and enjoy its leasehold and other estate hereunder. Lessor agrees to refrain from <br />interfering with, delaying or obstructing Lessee's exercise of any of its Rights hereunder, or similar <br />rights on other lands by any means whatever, including by filing protests or making objections to <br />governmental agencies regulating Lessee's business. <br />r <br />
