TDN FOLLOWUP INSPECTION <br /> 7 <br /> February 21 , 1990 <br /> MidContirent Fesourcees, Inc . <br /> PO Box 500 <br /> Carbondale, Colo <br /> Coal Basin mines <br /> Conditions at the mine during the inspection; ground cover : snow <br /> covered with three to six inches on the area inspected, no melt <br /> occurring during the inspection; weather : overcast and cold <br /> Personnel Present During the Inspection: Lou Ron Thompson: <br /> Mi dC�anti neat Resources <br /> Dill Crick: Colorado Mined Land Reclamation Division <br /> Gary Fritz : OSM, Albuquerque Field Office, #244 <br /> GENERAL COMMENTS <br /> This was a Ten Day Notice (TDN) f of 1 owup inspection for part one of <br /> nine of TDN #69-02-244-5. The violation was written for the companys <br /> failure to pass surface drainage from the lamphouse yard through a <br /> sediment pond prior to discharging it from the permit area. <br /> The Mined Land Reclamation Division (MLRD) responded to the TDN, the <br /> Albuquerque Field Office reviewed their response for this portiond <br /> and found it to be arbitrary and capricious. The MLRD appealed this <br /> office' s finding to reviewing officials in our Headquarters Office in <br /> Washington. The finding was upheld and a reinspection of the area in <br /> violation was ordered. The MLRD was notified of our intent to <br /> reinspect and a .joint inspection was scheduled. <br /> On arrival at the mines district office in Redstone, I met with the <br /> State inspector from the MLRD and company officials. I presented my <br /> identifiacation credentials as required and explained the purpose of <br /> the inspection. <br /> Mr . Thompson explained that the company was aware of the States TDN <br /> response, our review, the appeal and the OSM Headquarter' s finding <br /> regarding the appeal . In the interim, the company had decided to take <br /> steps to control the runoff from the area. <br /> We then drove to the lamphouse yard and reviewed the work that was <br /> done to evaluate the effectiveness of the new drainage control . They <br /> put in two berms on the area to insure that drainage would be <br /> directed to the sediment pond prier to discharging it from the permit <br /> area. One of the berms was an internal structure built close to the <br /> geographic center of the area to collect the major portion of the <br /> affected area drainage coming from the yard that would flow from the <br />
