DRAFT <br /> Subject To Board Approval <br /> Minutes , November 15 , 1989 PAGE 15 <br /> Two MOUs would be proposed, one for the Minerals Program and one for <br /> the Coal Program. Both MOUs should be prepared by the end of this <br /> month and will be sent to the Board for review. The MOUs should be <br /> finalized by this Board during the December Board Meeting. They will <br /> be presented to the Water Quality Control Commission in early January <br /> of 1990 for final consideration. It was noted that the Division will <br /> come back to the Board in the Spring of 1990 for Rulemaking, i.e., what <br /> criteria are to be used to establish points of compliance. <br /> 29. DISCUSSION ITEM: <br /> Fees--preliminary results of analysis of fees. Analysis recommended by <br /> Governor's Commission on Productivity and the Legislature. <br /> Staff presented ATTACHMENT G, including a summary of fees collected by <br /> the Division from 1982 to 89. It was noted that two directives, one <br /> from Governor's Commission on Productivity and one from the Joint <br /> Budget Committee, to analyze the fee structures for possible <br /> adjustment. The Legislature directed the MLR Minerals Land Program to <br /> evaluate other options to raise funds to support the activities of the <br /> Minerals Program. At this time, all revenues collected by the Division <br /> go into the General Fund. <br /> The Division hired an individual , Ms. Joanne Thompson, to 1 ) review the <br /> existing Division's Mineral Program fee structure and fees and 2) <br /> determine appropriate factors to increase fees relative to inflation - <br /> since 1976. The Board suggested that the Program, including fee <br /> structure, be revisited in terms of resource allocation. <br /> The current fee schedule and structure were discussed briefly. Ms. <br /> Thompson conducted research to determine an appropriate index to use <br /> for adjusting fees. The Producers Price Index (PPI), in relation to <br /> metals and non-metals, was discussed. Staff stated that this Index was <br /> a valid index to use as a justification for fee adjustments. <br /> Staff suggested that the Board could appoint a committee to review the <br /> issue of an alternative fee schedule, and the Board agreed with this <br /> suggestion. <br /> Staff Presentation by Bruce Humphries: <br /> 30. DISCUSSION ITEM <br /> Board review and approval of new Minerals Forms. <br /> Staff presented ATTACHMENT H - revised form letters for Annual Fees and <br /> Civil Penalties, including—the� letter to be sent out 60 days prior to <br /> the Anniversary Date of an application, and these were discussed with <br /> the Board. The Board reviewed and suggested some modification. <br /> It was MOVED that the Board approve these Fee Form Letters , with the <br /> changes—. -MCONDED AND PASSED UNANIMOUSLY (Kraeger-Rovey, Donald, <br /> Jouflas and Cooley). <br />
