Both MOUs should be prepared by the end of this month and will be sent to the Board for review. The MOUs should be finalized by this Board during the December Board Meeting. They will be presented to the Water Quality Control Commission in early January of 1990 for final consideration. It was noted that the Division will come back to the Board in the Spring of 1990 for Rulemaking, i.e., what criteria are to be used to establish points of compliance. 29. DISCUSSION ITEM: Fees--preliminary results of analysis of fees. Analysis recommended by Governor's Commission on Productivity and the Legislature. Staff presented ATTACHMENT G, including a summary of fees collected by the Division from 1982 to 89. It was noted that two directives, one from Governor's Commission on Productivity and one from the Joint Budget Committee, to analyze the fee structures for possible adjustment. The Legislature directed the MLR Minerals Land Program to evaluate other options to raise funds to support the activities of the Minerals Program. At this time, all revenues collected by the Division go into the General Fund. The Division hired an individual , Ms. Joanne Thompson, to 1 ) review the existing Division's Mineral Program fee structure and fees and 2) determine appropriate factors to increase fees relative to inflation - since 1976. The Board suggested that the Program, including fee structure, be revisited in terms of resource allocation. The current fee schedule and structure were discussed briefly. Ms. Thompson conducted research to determine an appropriate index to use for adjusting fees. The Producers Price Index (PPI), in relation to metals and non-metals, was discussed. Staff stated that this Index was a valid index to use as a justification for fee adjustments. Staff suggested that the Board could appoint a committee to review the issue of an alternative fee schedule, and the Board agreed with this suggestion. Staff Presentation by Bruce Humphries: 30. DISCUSSION ITEM Board review and approval of new Minerals Forms. Staff presented ATTACHMENT H - revised form letters for Annual Fees and Civil Penalties, including—the� letter to be sent out 60 days prior to the Anniversary Date of an application, and these were discussed with the Board. The Board reviewed and suggested some modification.
