BANTA, Director <br /> DATE: December 15, 1989 <br /> TO: Mike Long, Fred Banta <br /> FROM: Bill Cri ck�'` <br /> RE: Coal Basin Mines (C-81-017) NOVs C-89-032 and C-89-033, <br /> Request by Operator to Vacate <br /> On December 7 we received a request for assessment conference which should <br /> also be treated as a request to vacate the violations. Both NOVs were written <br /> as a result of a complete inspection on October 31 to November 3. <br /> The mine ID sign has for years been located at the intersection of the mine <br /> access road and Highway 133 in Redstone, which is several miles away from the <br /> permit boundary. Although the road does lead only to the mine site, it is a <br /> public road until reaching the permit area. This may to a degree restrict <br /> access to a National Forest trailhead, and in any case is a clear violation of <br /> Rule 4.02.20 ) . <br /> The topsoil Violation involves about a 100-foot length of an access road, <br /> built in 1988, where trees and brush are protruding from the road fill . The <br /> Revision allowing this construction called for stripping of 1030 cubic yards <br /> of topsoil , and my estimate is that approximately 20 cubic yards were buried <br /> by the fill . <br /> Althouah both issues involve minimal environmental impact, I cannot recommend <br /> that either of them be vacated.
