Further, 4. 06.2(1) also provides that "Vegetation cover shall be <br /> cleared only from areas to be affected, to the extent necessary . <br /> In this instance, Mid-Continent does not believe that the <br /> regulations direct, nor that it would have been proper, to remove <br /> vegetation and topsoil in any area other than the specific area <br /> necessary to and intended for the construction of the road; Mid- <br /> Continent's disturbance was confined to that surface area necessary <br /> to and intended for the road construction. <br /> Mid-Continent acted, in essence, to minimize surface disturbance. <br /> The clearing of vegetation and removal of topsoil beyond areas <br /> identified as necessary for the road itself would have had the <br /> effect of maximizing surface disturbance, something the Act and <br /> Regulations do not approve, and certainly do not require.
