Phillips <br /> Assistant Attorney General <br /> RE Mid-Continent bond and surety <br /> DATE : August 31, 1982 <br /> Enclosed are a letter from Bob Delaney and attached proposed <br /> amendments to Mid-Continent 's reclamation bond and mortgage deed. <br /> I have reviewed them and, subject to the following comments , find <br /> them acceptable. <br /> On the first page of the bond amendment, please confirm <br /> whether the recalculation occurred as part of the Division's "final <br /> review of the Coal Basin Mine Permit Application, " and, of course , <br /> that the amount is correct as stated. If you have any question <br /> about the "final review" language , let me know. <br /> The mortgage deed amendment should be styled "second amend- <br /> ment . " <br /> For the Division 's review, I would also call your attention <br /> to the fact that the appraisal on the property (which estimated the <br /> value at $2 , 000 , 000 , or just over the new bond amount) was done in <br /> December 1979 . <br /> If the Division's review finds these amendments acceptable , <br /> you should so inform Bob Delaney . He will have them executed by <br /> Mid-Continent and, following approval from the Board, recorded. <br /> He will then have the title insurance extended to cover the in- <br /> creased amount , <br /> If you have any questions , please contact me . <br /> PCP :jh <br /> Enclosure <br />
