5. The terms of this Order are such that Mid-Continent <br /> shall be permitted an opportunity to sell the mine to a qualified <br /> purchaser able to post all required performance bonds, and per- <br /> mitted an opportunity to abate the violations identified in the <br /> NOV' s. Accordingly, the Division shall not initiate any action <br /> to :=orfeit the reclamation bond or collect the deficiency unless <br /> Mid--Continent first fails to perform one of its obligations under <br /> this Order, or one of the conditions identified in this Order <br /> fails to occur . <br /> 6. Mid-Continent shall provide the Division with a copy of <br /> each quarterly report produced during the time for the perfor- <br /> mance of the terms of this Order . <br /> 7 . Mid-Continent shall maintain the site in compliance <br /> with all applicable statutes, regulations and permit conditions. <br /> 8. Mid-Continent shall provide the Division with evidence <br /> of adequate, current liability insurance on the mine site and <br /> shall complete the required abatement for NOV Nos. C-90-049, <br /> C-90-050, C-90-051 and C-90-52 by April 19, 1991. <br /> 9. The $4,000 . 00 civil penalty assessed for NOV Nos. <br /> C-90-049, C-90-050, C-90-051 and C-90-052 shall be suspended if <br /> the site is permitted and bonded by a qualified purchaser and <br /> Mid-Continent performs all of its obligations under this settle- <br /> ment agreement . The civil penalty shall be due and payable upon <br /> failure to perform any such obligation. <br /> 10. By June 28, 1991 Mid-Continent shall provide the Divi- <br /> sion with clear and convincing evidence that it has received and <br /> accepted a bona fide offer from a qualified purchaser who stands <br /> ready, willing and able to purchase the Coal Basin Mine, and that <br /> such purchaser fully intends to obtain a permit to continue coal <br /> mining operations at the site. <br /> 11. By September 30, 1991, Mid-Continent shall provide the <br /> Division with clear and convincing evidence that the Coal Basin <br /> Mine has been sold to a bona fide purchaser who intends to obtain <br /> a permit to continue coal mining operations at the site. <br /> 12. By October 30, 1991, the purchaser of the Coal Basin <br /> Mine shah, submit an application for a permit transfer , or for a <br /> new permit, to conduct coal mii.; ng operations at the Coal bas r. <br /> mine. It shall be Mid-Continent ' s obligation to assure that such <br /> event occurs. <br /> 13 . By January 2, 1992 Mid-Continent ' s successor shall <br /> -2- <br />
