BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> File No. C-81-017 <br /> ----------------------------------------------------------------- <br /> ORDER <br /> ----------------------------------------------------------------- <br /> IN THE MATTER OF MID-CONTINENT RESOURCES, INC. ; <br /> WHY PERMIT SHOULD NOT BE SUSPENDED OR REVOKED <br /> ORDER TO SHOW CAUSE. <br /> ---•-------------------------------------------------------------- <br /> This matter came before the Mined Land Reclamation Board <br /> ( "Board" ) for a hearing on April , 1991 for consideration of <br /> an Order to Show Cause Why the Permit Should Not Be Suspended or <br /> Revoked ( "Order to Show Cause" ) . Mid-Continent Resources, Inc. <br /> ( "Mid-Continent" ) and the Mined Land Reclamation Division <br /> ( "Division" ) have entered into a Settlement Agreement and have <br /> proposed this Order to resolve the issues presented by the Order <br /> to Show Cause, as well as issues raised by the subsequent issu- <br /> ance of NOV Nos. C-90-049, C-90-050, C-90-052 and C-90-53 , and <br /> issues raised by the mid-term review of Mid-Continent ' s permit. <br /> The Board, having reviewed the terms of the Settlement Agreement, <br /> hereby enters the following order : <br /> 1. The Order to Show Cause shall be amended to include NOV <br /> Nos. C-90-049, C-90-050, C-90-051 and C-90-052 in the pattern of <br /> violations cited. <br /> 2 . The cited violations constitute a pattern of violations <br /> caused by an unwarranted failure of Mid-Continent to comply with <br /> the requirements of its permit and the Colorado Surface Coal <br /> Mining Reclamation Act. <br /> 3 . The cited pattern of violations does not justify perrL,.t <br /> revocation so long as Mid-Continent takes immediate and decisive <br /> steps to correct existing problems to prevent future violations, <br /> and fully complies with the terms of this Order . <br /> 4 . The performance bond on the site shall be increased by <br /> $800,000 .00 to a total of $3,800, 000 .00. The deficiency in the <br /> performance bond shall be immediately due and payable. <br />
