Box 500 <br /> Carbondale, Colorado 81623 <br /> RE: Coal Basin Mines (C-81-017) , Small-Area Exemption Demonstrations Dated <br /> December 11 , 1990. <br /> Dear Mr. Thompson: <br /> The Division has reviewed these demonstrations and finds that the following <br /> issues must still be addressed: <br /> Mid-Continent must demonstrate either that the 10-year, 24-hour runoff from <br /> each area will be contained by a berm or other treatment facility, or that the <br /> runoff from each area is a non-point source discharge and can therefore be <br /> exempted from sediment control requirements. The first option would require <br /> that runoff calculations ano a structure design be submitted for each area, to <br /> be reviewed by the Division. For the second option, it is recommended that <br /> you contact the Water Quality Control Division concerning whether non-point <br /> source designations are appropriate for these areas. <br /> There are also some inconsistencies in the submittal : <br /> - Exhibit B appears to be an example Findings Document page, which is not <br /> necessary as part of this submittal . <br /> - Area No. 4 in Exhibit A is listed as Area No. 3 in Exhibit B. <br /> - Area No. 3 in Exhibit A is not listed at all in Exhibit B. It is also <br /> not mapped in either this submittal or in the permit application. The <br /> calculations for this area (0,62 acres) can't be verified for these <br /> reasons. <br /> - Statement 2 of the cover letter is not true. <br /> With correction of the above issues, the demonstrations for alternative <br /> sediment control will be approved. <br /> Sincerely, <br /> William B.
