but that such failure is not due to lack of diligence on the part of the
operator. The time for abatement is, therefore, extended to September 20,
1991 .
The conditions, practices or violations as to which this extension
applies are as follows:
Abatement conditions of NOV C-90-049 as applied to Pond 4-1 at Mine No. 4.
Extension does not apply to Mine No. 3 Bin Pad Pond (Pond 023).
