Dear Mr. Savage:
During the inspection of October 23 , 1990 the Division issued four
notices of violation, including NoV(s) C-90-049 , C-90-051 and C-90-
052 , which require abatement by November 23 , 1990 , and C-90-050 ,
which requires abatement by December 23 , 1990 .
The abatement steps, including modification of ponds, repair of
road culverts, repair of a ditch, and repair and/or construciton of
sediment control structures, require extensive work which is not
feasible or desirable during the winter months .
As you know, the mine site is at high elevation (8 , 000' to 10 , 0001 )
and we have already entered the frost and snow season. Completion
of the work required by the NoVs under frost and snow conditions
would be difficult if not impossible, and the disturbance to the
ground would be environmentally harmful.
Accordingly, Mid-Continent requests an extension of the period
allowed for abatement by 90 days in consideration of the the
climatic conditions at the mine site.
The regulations of the Division at §5 . 03 . 2( 2) (b) provide that an
extension of the abatement period originally fixed may be allowed
when due to circumstances which include at §5 . 03 . 2( 2) (c) (iv) :
