The regulations also, at §5.03 .2(2) (g) , allow a further extension <br /> "Where the condition or circumstance which prevented <br /> abatement within 90 days exists at the expiration of such <br /> extension. . " <br /> Mid-Continent's previous request for extension explained that: <br /> is The abatement steps, including modification of <br /> ponds, repair of road culverts, repair of a <br /> ditch, and repair and/or construction of <br /> sediment control structures, require extensive <br /> work which is not feasible or desirable during <br /> the winter months. <br /> As you know, the mine site is at high <br /> elevation (8,0001 to 10,0001 ) and we have <br /> already entered the frost and snow season. <br /> Completion of the work required by the NoVs <br /> under frost and snow conditions would be <br /> difficult if not impossible, and the <br /> disturbance to the ground would be <br /> environmentally harmful . " <br /> The winter conditions at the mine site continue in effect, making <br /> abatement work infeasible.
