Routten <br /> Mined Land Reclamation Division <br /> Room 215 <br /> 1313 Sherman <br /> Denver, CO 80203 <br /> RE: NoV C-90-049, C-90-050, C-90-051, C-90-052 <br /> Dear Mr. Routten: <br /> Mid-Continent Resources requests an extension of the period for <br /> abatement of Notices of Violation C-90-049, C-90-051 and C-90-052, <br /> and C-90-050, which were written at the time of the October 23 , <br /> 1990 inspection. <br /> Mid-Continent requested, and the Division granted, an extension of <br /> the abatement period in consideration of the climatic conditions at <br /> the mine site, which make it infeasible to carry out the necessary <br /> work during the winter months. <br /> NoVs C-90-049, C-90-051 and C-90-052 had originally required <br /> abatement by November 23 , 1990 , and NoV C-90-050 had required <br /> abatement by December 23 , 1990. The Division, on November 21, <br /> 1990, issued an extension of the abatement period until January 21 , <br /> 1991 for all the notices of violation (with the exception that <br /> repair of the East Sutey Pile ditch be completed by November 23, <br /> 1990, as originally required by NoV C-90-051. The work was <br /> completed in the required time period) . <br /> The regulations of the Division provide that an extension of the <br /> abatement period originally fixed may be allowed when due to <br /> circumstances which include, at §5.03 .2(2) (c) (iv) : <br /> Where climatic conditions preclude abatement within 90 <br /> days, or where, due to climatic conditions, abatement <br /> within 90 days clearly would cause more environmental <br /> harm than it would prevent; <br />
