Hickenlooper <br />Governor <br />Mr. Kurds Blunt Mike King <br />Colowyo Coal Company Executive Director <br />5731 State Highway 13 Loretta Pineda <br />Meeker, CO 81641 Director <br />Re: Colowyo Mine, Permit No. C- 1981 -019, Adequacy letter for Permit Renewal No. 6 <br />Dear Mr. Blunt: <br />The Division of Reclamation, Mining and Safety (the Division) has reviewed Colowyo Coal Company's <br />(CCC's) responses to our preliminary adequacy (letter from CCC July 27, 2012), and we have the <br />following comments and questions. Please address the remaining issues at your earliest convenience. <br />As a reminder, since the Division received the application for renewal on time, CCC retains the right of <br />successive renewal for Coal Mining Permit Number C- 1981 -019. <br />1. Stipulations <br />Stipulation 7 relates to a groundwater point of compliance. This stipulation needs to be resolved between <br />CCC and the Division. <br />2. Discrepancies with Areas <br />There are some discrepancies between the amount of acres in the RN -06 application (page 3) and values <br />in the Division's Permit System (see decision form for TR -94). This includes: <br />• Surface ownership (Federal) <br />• Surface ownership (Private) <br />• Disturbed area. <br />Please explain what might have changed regarding these area calculations. Are the numbers in the 2011 <br />ARR correct? What explains the differences between Tables 3 -1 and 3 -2 <br />3. Reclamation Plan <br />a. Regarding the new Table 2.03 -1 submitted with RN -06, please explain why there is much more <br />reclaimed area than disturbed area in the total row at the bottom of the table. Please explain how <br />these values are calculated. It would seem that total disturbed values would be at least as large as <br />total reclamation values. <br />b. The duplication of text and pagination issues have been resolved by Colowvo's submittal of a <br />reformatted Section 2.05. This response is acceptable. <br />
