` Mid-Continent has several federal leases for mining coal in the Coal Basin <br /> watershed. Federal Leases, C-09004, C-09005, and C-0125457 have roads and/or <br /> mine workings located on them. <br /> Lease C-09004 <br /> Pertinent clauses protecting the integrity of National Forest lands: <br /> STIPULATION FOR LANDS UNDER JURISDICTION OF DEPARTMENT OF AGRICULTURE <br /> (Form 3109-3) <br /> This stipulation states "The lands embraced in this lease or permit being under <br /> the jurisdiction of the Secretary of Agriculture, the lessee or permittee <br /> here-by agrees:" <br /> Stipulation # 3 - "In the location, design, construction, and maintenance of <br /> all authorized works, buildings, plants, waterways, road, telegraph or <br /> telephone lines, pipelines, reservoirs, tanks, pumping station, or other <br /> variances or clearance, the lessee or permittee will do all things reasonably <br /> necessary to prevent or reduce to the fullest extent scarring and erosion of <br /> lands, pollution of the water resources and any damage to the watershed. Where <br /> construction, operation, or maintenance of any of the facilities on or <br /> connected with this lease or permit causes damage to a watershed or pollution <br /> of the water resources, the lessee or permittee agrees to repair such damage <br /> and take such corrective measures to prevent further pollution or damage to the <br /> watershed as are deemed necessary by the authorized representative of the <br /> Secretary of Agriculture." <br /> The authorized representative being the District Ranger, Sopris Ranger <br /> District. <br /> Leases C-09005 and C-0125457 <br /> Pertinent clauses protecting the integrity of National Forest lands: <br /> Sec.7. DAMAGES TO PROPERTY AND CONDUCT OF OPERATIONS - <br /> "Leasee shall comply at its own expense with all reasonable orders of the <br /> Secretary, respecting diligent operations, prevention of waste, and PROTECTION <br /> OF OTHER RESOURCES (our emphasis) . . ." <br /> In addition, "Leasee shall carry on all operations in accordance with approved <br /> methods and practices as provided in the operating regulations, having due <br /> regard for the prevention of injury to life, health, or property, and <br /> prevention of waste, damage or degradation to any land, air, WATER (our <br /> emphasis) , cultural, BIOLOGICAL (our emphasis) , visual and other resources <br /> including mineral deposits . . .", "Leasee shall take measures deemed necessary <br /> by lessor to accomplish the intent of this lease term. Such measures may <br /> include, but are not limited to , modification to proposed siting or design of <br /> facilities, timing of operations, and specification of interim and final <br /> reclamation procedures. . .", "Leasee shall condition such uses to prevent <br /> unnecessary or unreasonable interference with rights of leasee as may be <br /> consistent with concepts of multiple use and multiple mineral development." <br />
