Coal Basin Group - 3 -- March 29, 1991
5 . We do not find the discrepancy between the County and State
permits, in regard to the construction deadline for the water
treatment plant, to be contradictory. We have no objection to the
County permit condition nor do we question its validity.
MARCH 13, 1991 DIVISION OF WILDLIFE LETTER
1 . We will be meeting with the Forest Service in early April and will
try to come to agreement with the Forest Service and Mid-Continent
on short and long term haul road and portal bench maintenance,
stabilization and reclamation needs, as well as a schedule for
submittal of appropriate plans and time tables for implementing
such plans.
2. In regard to identification of potential sources of toxicity, core
sampling of the refuse piles may not be necessary. Alluvial
monitoring wells and surface water sampling sites immediately below
both the old and new refuse piles have been in place for a number
of years , and that monitoring data is on file and available for
review. If potential toxins which have not been included in
previous sample analyses are suspected, it would be appropriate to
collect water samples from potential contaminant sources, such as
the refuse piles , mine water discharge, etc. , as well as possible
non--mine related sources and analyze for the parameter(s) of
concern. We would certainly be willing to participate in this
effort.
3. We share your concern with maintenance of the drainage control
system during the period of temporary cessation, and we will
conduct frequent inspections to insure that necessary maintenance
is being performed.
gaw
cc: Mike Savage
Steve Renner
Fred Banta
Diane Delaney, Mid--Continent Resources
4534F
