Coal Basin Group - 2 -- March 29 , 1991 <br /> 2. We will respond to the issue of Federal NOVs for unpaid AML Fees in <br /> separate letter correspondence. <br /> 3. We do not agree that violations still exist in relation to <br /> TDN 90-02.370--001 , and we will respond in a separate letter. <br /> 4. We will conduct inspections, collect water samples and insure that <br /> sediment ponds are properly maintained in accordance with the OSM <br /> suggestions. As long as the ponds are properly maintained, they <br /> are sized adequately to handle the mine discharge and storm runoff <br /> from the 10--year, 24-hour storm event. Mid--Continent has been <br /> required to submit information on current pond sediment levels <br /> along with a pond monitoring and maintenance schedule which will be <br /> followed during the period of temporary cessation. We will keep <br /> Coal Basin Group members informed of site conditions and water <br /> sampling results. <br /> 5. The water treatment plant technical revision has been approved, <br /> with the condition that it be fully installed and operating within <br /> 60 days of resumption of active status. Garfield County's recently <br /> approved special use permit amendment specifies that the plant be <br /> operational prior to resumption of coal production. We have no <br /> objection to the County's condition, and we see no need to modify <br /> our permit at this time. The permittee is obligated to install the <br /> treatment plant prior to resumption of operations, as specified in <br /> the land use permit amendment. <br /> MARCH 14 , 1991 PITKIN COUNTY LETTER <br /> 1 . We concur with the short term concerns , and we will conduct <br /> inspections at Coal Basin at least twice monthly during April <br /> through July and at least monthly thereafter. <br /> 2. We will continue to work with the Forest Service on the issue of <br /> road and portal bench maintenance, stabilization and reclamation <br /> and will try to incorporate their concerns into the Show Cause <br /> Settlement Agreement, as well as the mid-term review. We plan to <br /> meet with Forest Service personnel in early April to discuss these <br /> matters. <br /> 3. We believe the macroinvertebrate study could be very important and <br /> should be carried to its conclusion. We will advise Mid--Continent <br /> of our interest in seeing the study completed. <br /> 4. We share the concerns expressed regarding a potential future <br /> operator and the need for a firm date for initiation of final <br /> reclamation, should the mine not be sold. We will attempt to <br /> structure the Show Cause Settlement Agreement to address these <br /> concerns. <br />
