STATE OF COLORADO
MINED LAND RECLAMATION DIVISION oe co
Department of Natural Resources
1313 Sherman St., Room 215
Denver,CO 80203 * *
303 866-3567 18,76•
FAX: 303 832-8106
Roy Romer,
Governor
Fred R.Banta,
Division Director
June 6, 1991
Mr, Robert Hagen, Director
Albuquerque Field Office
Office of Surface Mining
Reclamation & Enforcement
625 Silver Avenue, S.W., Suite 310
Albuquerque, New Mexico 87102
RE: Coal Basin Mine (File No. C-81 -017)
Dear Mr. Hagen:
I would like to take this opportunity to summarize our conversation of
June 5, 1991 , regarding the recent AFO inspection of the Coal Basin Site
and federal inspections of permitted operations in Colorado.
I understand that representatives of the Albuquerque Field Office and of
the Western Support Center inspected the Coal Basin Site on June 5, 1991 .
The purpose of the inspection was to gather information relevant to a
reclamation cost estimate being prepared by the WSC. As we discussed,
Colorado had not been notified of the inspection, contrary to
30 CFR 842.11 (a)(1 ) .
I understand that this was not an oversight inspection. As such, I would
not anticipate that any enforcement actions in the form of Ten Day Notices
or Letters would result. It is my understanding the the lack of notification
was an oversight within the AFO, and that the staff will be advised to observe
proper notification procedures in the future.
I would request that AFO provide us with copies of the inspection report and
any relevant information obtained during the inspection. These materials
would be helpful as we continue to monitor the site.
