Box 309 <br /> Agriculture Forest Carbondale, CO 81623 <br /> (303)963- 66 <br /> Reply: 2720/2530 <br /> Date: June 11 , 1991 <br /> Ms. Diane Delaney <br /> Mid-Continent Resources, Inc. <br /> 201 Centennial Street <br /> Suite 406, Drawer 122 <br /> Glenwood Springs, CO 81601 <br /> Dear Diane: <br /> This letter is a follow-up of our telephone conversation on June 7, 1991 , <br /> regarding maintenance practices for ditch cleaning operations for the access <br /> roads in Coal Basin. <br /> On June 5, 1991 , while performing an inspection, Henry Austin and Robert Inman <br /> of the Office of Surface Mining (OSM) , and Tony Svatos of the White River <br /> National Forest, observed that the ditch along Forest Road #307 had been <br /> cleaned and the material removed from the ditch had been disposed of over the <br /> cut slope of the road and into Coal Creek. Lew Thompson indicated that this <br /> work had been performed by Mid-Continent Resources. <br /> Please reference Special Use Permit (Road) , issued 6/8/87, provision #2. <br /> Section 208 and Section 313 of the Clean Water Act provide for controlling, to <br /> the extent feasible, sources of nonpoint water pollution by applying best <br /> management practices. The procedure being utilized currently for disposal of <br /> ditch material is not an acceptable maintenance practice and should be <br /> immediately ceased. This material is ending up directly in Coal Creek, <br /> material remaining on the bank will eventually be washed into Coal Creek, and <br /> is impeding the establishment of vegetation. <br /> Provision #10 of the Special Use Permit provides for an approved maintenance <br /> plan, which would include disposal procedures of ditch material. This needs to <br /> be a discussion item when we meet to develop treatment of roads in Coal Basin. <br /> Please contact myself prior to any maintenance on the roads under Special Use <br /> Permit if this work will be performed prior to our road treatment meeting.
