' . t <br /> ' CONSTRUCTION DEWATERING <br /> OPERATIONS IN COLORADO <br /> GENERAL PERMIT FOR DISCHARGE <br /> RATIONALE <br /> COLORADO DISCHARGE PERMIT NUMBER: COG-070000 <br /> Excavation dewatering in conjunction with construction activities often results <br /> in temporary discharges to waters of the United States. These discharges are <br /> subject to the requirements 25-8-101 et. seq. , CRS, 1973 as amended. Obtaining <br /> a discharge permit may be essential to the construction activity and its <br /> scheduling. Administrative delays in the issuance of a permit might <br /> significantly impact the timing and cost of a project. Situations have arisen <br /> in the past where permit processing delays, or anticipation of delays, have <br /> resulted in applicants discharging prior to receipt of authorization. The <br /> intent of a General Permit for construction dewatering is to facilitate the <br /> scheduling of these activities by reducing the administrative delays in their <br /> authorization, to establish a uniform criteria for management practices and <br /> effluent limitations for discharges from these activities, and promote a <br /> consistent permitting and enforcement posture with respect to these activities. <br /> The General Permit regulations provide for the issuance of General Permits <br /> where covered facilities: <br /> 1. are involved in substantially the same type of operations; <br /> 2. discharge the same type of waste; <br /> 3. require the same effluent limitations or operating conditions; <br /> 4. require similar monitoring; and, <br /> 5. are more appropriately controlled under a General permit than <br /> individual permits. <br /> Applicability <br /> This category, "construction dewatering", will include dewatering from building <br /> construction, general construction, highway, bridge and tunnel construction, <br /> among others considered appropriate by the Division. The dewatering associated <br /> with this construction activity will be relatively short-term and will not <br /> include any pollutants other than those which normal physical disturbance, <br /> pumping, or construction activity might create. Overburden removal is not <br /> considered a. construction activity. The Division retains the authority to <br /> individually permit facilities determined to be in noncompliance with the <br /> conditions of this General Permit or not qualifying for a General Permit. (see <br /> PART II, B. 5, page 13 of the permit) <br />
