Description of BMPs during Remediation Activities: The plan shall describe BMPs that will be <br /> implemented to reduce the potential of remediation activities to contribute pollutants to <br /> stormwater discharges. Activities that shall be addressed include vehicle maintenance, earth <br /> moving, material storage and spill prevention. <br /> This section is intended to address BMPs that will be used to control potential pollution sources that will be <br /> created or exaggerated due to remediation activities. See page 4 of this document for further explanation of this <br /> item. <br /> e. Procedures for Disposal of Water Stored Within Mine Waste: The permittee must describe how <br /> any water stored within the mine waste will be collected and/or routed to any storage or <br /> treatment facilities. No discharge of this water shall be made to waters of the state, unless <br /> separate permit coverage is obtained. <br /> This general permit only authorizes stormwater discharges; stormwater is precipitation-induced runoff. Water <br /> stored in tailings impoundments or other areas of mine waste is not runoff. The characteristics of these stored <br /> waters can vary dramatically on a site-by-site basis and can have deleterious impacts if discharged into receiving <br /> waters. Because of the nature of these waters (not runoff) and the potential water quality impacts, discharge is <br /> not authorized under this permit. An individual permit would be required which allows for site-specific <br /> assessment of the quality, quantity and impacts of the stored water. <br /> f. Description of Permanent BMPs, Final Site Stabilization, and Ultimate Land Use: The plan <br /> shall include a description of the specific permanent measures that will be installed or used at <br /> the mine-waste site. The description shall include any of the following if appropriate: <br /> specifications for capping or isolation of the mine waste, method and type of revegetation, and <br /> other permanent BMPs. The plan shall also include a description of the ultimate land use after <br /> remediation is complete. <br /> The permanent BMPs, final stabilization, and ultimate land use of the site must meet the criteria described <br /> above for permittees seeking to terminate coverage through the mine-waste remediation method. These include <br /> removal or permanent isolation of raw materials, intermediate products, byproducts, finished products and <br /> waste products, completion of all soil disturbing activities, and revegetation meeting the required criteria. <br /> 6. Consistency with Other Plans <br /> SWMPs may reflect requirements for Spill Prevention Control and Countermeasure (SPCC)plans <br /> under section 311 of the CWA, or Best Management Practices (BMPs) Programs otherwise required <br /> by a CDPS permit, and may incorporate any part of such plans into the SWMP by reference. The <br /> SWMP may reflect information contained in approved plans submitted for other similar pollution <br /> control programs, including the Voluntary Clean Up Program. (Voluntary Cleanup and <br /> Redevelopment Act, CRS 25-16-303) as long as they contain the elements described above. These <br /> plans must have been approved by the implementing agency prior to application for the Stormwater <br /> Permit. Appropriate portions of these other plans maybe incorporated in the SWMP by reference, <br /> as long as a complete SWMP can be reproduced and submitted to the requesting agency within the <br /> time frame specified in the request. Those portions of the'referenced documents must be included in <br /> the submittal. The SWMP must also be readily available to an on-site inspector. <br /> If the facility, or a portion of it, is already regulated through another program which requires such things as <br /> SPCC plans or good housekeeping measures, these can be included by reference. <br />
