Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />Dear Mr. Clark: <br />We have reviewed your letter dated April 6, 2012 requesting an amendment to the <br />current Substitute Water Supply Plan ( "SWSP ") for the above mentioned gravel pits. The <br />SWSP is a combined replacement plan that identifies replacement sources to cover depletions <br />from two adjacent mine sites operated by Ready Mixed Concrete Company ( "RMCC "). It was <br />most recently approved on August 8, 2011 and is valid through December 31, 2012 unless <br />extended to July 31, 2013 per condition #1. This amendment only affects the Bromley Lakes Pit <br />and thus only one renewal fee is required. That required fee of $257 has been submitted <br />(receipt no. 3655001). <br />This amendment seeks to add additional mining production and dewatering of Bromley <br />cell 3 into the approved SWSP. All other operations and terms and conditions not specifically <br />changed below remain in effect for the SWSP. <br />Dewatering Operation <br />RMCC plans to start dewatering cell 3 in July of 2012 and will maintain a dewatered <br />state until mining finishes in December 2015. In 2012 RMCC will install a slurry wall around cell <br />3 as well as surrounding land to the east known as the Arends, Reinoehl, and Archuleta parcels. <br />The partially mined cell 3 as well as the Arends, Reinoehl, and Archuleta parcels will then be <br />mined out creating one water storage reservoir. During the first few months the dewatering rate <br />will be at an estimated flow rate of 44.2 acre -feet per day (10,000 gallons per minute, gpm). <br />This water will be discharged directly to the river with no beneficial use. After the initial high <br />dewatering rate required to empty cell 3, RMCC projects a much lower pumping rate will be <br />required to maintain the pit in a dewatered state. From past experience, when cell 3 was <br />previously in a dewatered state, RMCC approximates a steady state dewatering rate of 4.3 <br />acre -feet per day (975 gpm).
