0 <br />application review and approval processes. The application shall be <br />accompanied by at least five (5) copies or as many additional copies as <br />specified by local requirements, of an engineering design and operations <br />report prepared in accordance with these regulations, unless the proposed <br />solid waste disposal facility is a privately operated Solid Waste -to- Energy <br />Incineration facility not under contract to a county and /or municipality or is a <br />solid waste incineration facility, in which case Sections 1.6 and 11.2 <br />through 11.5 shall apply. The application shall also include all other <br />documents specified by local requirements. After receipt of an application, <br />the governing body having jurisdiction shall forward copies of the <br />application and at least five (5) copies of the engineering design and <br />operations report to the Department for review and a recommendation for <br />• approval or disapproval. <br />1.6.3 Recommendations on certificate of designation applications, including the <br />engineering design and operations report, shall be based upon compliance <br />with the Act and these regulations. <br />1.6.4 The Department shall conduct a technical review of each application for a <br />certificate of designation for a solid waste disposal site and facility. This <br />review shall have two parts which are defined in the following subsections. <br />1.6.5 An application for a certificate of designation for a proposed solid wastes <br />disposal site and facility shall be reviewed by the Department to determine <br />if the contents of the application are complete as submitted. <br />(A) The Department shall make an initial decision concerning the <br />completeness of the application and its associated technical documents <br />within thirty (30) days of the receipt of the application as a referral from the <br />local governing body having jurisdiction. The Department shall base this <br />decision on the content of the application, as submitted. The Department <br />shall notify the applicant and local governing body having jurisdiction <br />whether or not the comprehensive technical evaluation of the application <br />• will proceed. This notice shall be provided in writing to both the applicant <br />and the local governing body having jurisdiction. <br />(B) If the Department fails to provide the applicant and the local governing <br />body having jurisdiction with its written decision concerning the <br />completeness of the application within the specified thirty (30) day period, <br />the application will proceed through the comprehensive review described in <br />Subsection 1.6.6 below. <br />(C) This initial decision from the Department concerning the completeness <br />of the application will be based only on the completeness of the application <br />July 1, 2007 <br />• <br />33 <br />
