"Retailer" as used in Sections 10 and 16 of these Regulations means any <br />corporation, limited liability company, partnership, individual, sole proprietorship, <br />joint -stock company, joint venture, or other private legal entity that engages in the <br />sale of new lead -acid batteries, lubricating oil, or new tires directly to the <br />consumer. <br />"Reverse distributor" means a registrant with the US Drug Enforcement <br />Administration (DEA) who receives controlled substances acquired from another <br />DEA registrant for the purpose of returning unwanted, unusable, or outdated <br />controlled substances to the manufacturer or the manufacturer's agent; or where <br />necessary, processing such substances or arranging for processing such <br />substances for disposal. <br />"Run -off" means any precipitation or surface water that has not contacted solid <br />waste material and that drains over land from any part of a facility. <br />"Run -on" means any precipitation or surface water that drains over land on to any <br />part of a facility. <br />"Sanitary landfill" means a discrete area of land or an excavation for which the <br />final disposal of solid waste employs a method to obtain the most dense volume <br />practicable of the waste and covering with earth or other suitable material. A <br />sanitary landfill may receive household waste, community waste, municipal solid <br />waste, commercial waste, and industrial waste. <br />"Saturated zone" means that part of the earth's crust in which all voids are filled <br />with water. <br />"Secondary lead smelter" as used in Section 16 of these Regulations means a <br />facility that recycles lead- bearing scrap materials into elemental lead or lead alloys <br />by smelting. <br />"Seismic impact zone" means an area with a ten percent or greater probability <br />that the maximum horizontal acceleration in lithified earth material, expressed as a <br />percentage of the earth's gravitational pull will exceed O.1OG in 250 years. <br />"Self- certification checklist" means a checklist of regulatory requirements <br />applicable to entities affected by one or more Sections of these Regulations. <br />"Sharps" means any discarded article that may purposely or accidentally puncture <br />or cut the skin or mucosa.
