"Mining waste" means overburden to be discarded and other industrial wastes <br />directly related to the preparation, development and operation of mineral extraction <br />facilities. Mining waste includes only waste material directly connected with the <br />cleaning and preparation of substances mined by an operation are managed at the <br />mine site where they are generated. <br />"Monofill" means a landfill or section of landfill at which only one type of waste is <br />accepted for disposal. <br />"Municipal solid waste" means solid waste from household, community, <br />commercial and industrial sources that does not contain hazardous wastes as <br />defined in Section 25 -15- 101(9) of the Colorado Hazardous Waste Act unless <br />otherwise regulated by the Department. <br />"Municipal solid waste landfill (MSWLF)" means a sanitary landfill where one of <br />the main waste streams accepted is municipal waste. <br />"Municipal solid waste incinerator ash" means the bottom ash, fly ash or air <br />pollution control residues and other residuals of the combustion process from the <br />operation of incinerator or energy recovery facilities managing municipal solid <br />waste. <br />"Municipality" means a home rule or statutory city, town, or city and county, or <br />territorial charter city. <br />"National Priorities List (NPL)" means the list, compiled by the U.S. <br />Environmental Protection Agency pursuant to section 105 of the Comprehensive <br />Environmental Response, Compensation and Liability Act (CERCLA), 42 U.S.C. <br />§ 9605, of uncontrolled hazardous substance releases in the United States that are <br />priorities for long -term remedial evaluation and response. For the purposes of this <br />regulation, this term also includes sites that have been deleted from the NPL <br />following completion of the cleanup, but for which there are required, ongoing <br />operation and maintenance activities (including the implementation of institutional <br />controls). <br />"Noise pollution" means sound levels radiating from the site boundary, at a <br />distance of twenty -five feet (25') or more, in excess of standards established in <br />Sections 101 and 103 of the "Colorado Noise Abatement Act ", Title 25, Article 12, <br />Part 1, CRS, as amended. <br />"Noncommercial burning of trash" means the combustion of solid wastes in <br />accordance with CRS 30 -20 -110 of the Act. <br />15 <br />September 30, 2011 <br />
