Mr. Bobby Steele of NECC accompanied <br />the inspector. The mine site was damp but not wet. The area has been receiving Thunderstorms recently. It was <br />raining lightly off and on during the inspection with the center of a thunderstorm cell occurring to the Northeast of <br />the mine. The rain gauge located inside the shrub exclosure fence had 1.45 inches in the gauge. Talking with <br />other personnel at the New Elk Mine, a large storm event occurred on August 17, 2012. So the 1.45 inches of <br />precipitation in the rain gauge may have come from one large storm or several smaller storms. NECC personnel <br />do not check the rain gauge daily. A large storm event had occurred recently at the Lorencito Canyon Mine as <br />evidenced by considerable sediment in ditches and water being held in ponds. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />Permit records are stored at the New Elk Mine office, 12250 State Highway 12, Weston, CO. The records are <br />stored in Ron Thompson's office. File cabinets still need to be moved from the Trinidad NECC office. NECC <br />indicated that the Trinidad office would be closed at the end of August. <br />Records were verified on 8/23, and the records form is included at the end of this report. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 Placement; Drainage Control; Surface <br />Stabilization: <br />Overall the excess spoil fills held up well to the recent precipitation events. Fill 9 showed no rilling or gullying of <br />the fill itself or of the benches and 100 year diversion ditches. <br />Fill 7 exhibited no gullying of the face of the fill. The upper, east gully is showing additional down - cutting to the <br />east of the fill that will need some reinforcing to retard further down - cutting. Runoff from the haul road and <br />reclaimed parcels to the north of this ditch still makes it to the eastern fill ditch and ultimately to Pond 7. <br />Gully repairs NECC conducted on Fill 8 and east of Fill 8 in July 2012 held up well to the recent stone events. <br />Number of Partial Inspection this Fiscal Year: 2 <br />Number of Complete Inspections this Fiscal Year: 1 <br />Page 2 of 12 <br />
