GCC is maintaining the temporary berm on the south side of the quarry and has extended <br />the existing plant diversion ditch on the east side to prevent the inflow of stormwater from areas <br />outside of Mining Years 1 through 5. <br />2. Revision No AM -1. On September 27, 2011, DRMS approved a permit <br />amendment to remove 217 acres of the plant site from the current post- mining land use of Range <br />Land and to reduce the financial warranty from the current $5,065,081 to $1,313,475. <br />3. Technical Revision No. 2. On March 16, 2012 DRMS approved a request for a <br />technical revision addressing the following changes: <br />• Increase annual limestone production tonnage; <br />• Increase annual overburden stripping tonnage; <br />• Increase the number of acres undergoing active quarrying; <br />• Replace the hours of operation requirements for quarrying and overburden activities <br />with a restriction on daily production tonnages; <br />• Increase the amount ofthe reclamation bond to account for additional acreage <br />requiring reclamation; and <br />• Change the name of the facility to "Pueblo Cement Plant and Limestone Quarry." <br />To complete this Technical Revision, GCC has amended its Escrow Agreement to <br />increase the reclamation bond from $1,313,475 to $1,861,000. <br />4. Ground Water Monitoring. Five ground water monitoring wells have been <br />installed pursuant to the Mining Permit. These wells are identified as MWOO1A, MW002, <br />MW003, MW004 and MW005. MWOO1A, which was completed in the Codell Sandstone, and <br />MW005, which is a shallow well installed near the St. Charles River, have been determined to be <br />dry and have never produced enough water to sample. <br />In a letter dated December 8, 2009, DRMS established numeric protection levels <br />(NPL) for total dissolved solids, sulfate, Radium -226 and Radium -228. According to the letter <br />GCC is to continue semi - annual sampling and analysis of the ground water monitoring wells and <br />to submit an annual report of the results. GCC submitted its annual report for Calendar Year <br />2011 on February 16, 2012. <br />The TDS results from Monitoring Wells MW -003 and MW -004 obtained during <br />the October 2011 sampling event exceeded the NPLs established by DRMS. As a result, in <br />letter dated February 24, 2012, DRMS required that GCC resume quarterly groundwater <br />monitoring for TDS. GCC obtained First Quarter samples for TDS and the required semi - annual <br />samples for sulfate, Radium -226 and Radium -228 on March 20, 2012. GCC reported the sample <br />2 <br />
