Pursuant to Rule 1 .9, DMG
decision date is January 8, 2001 . Please be advised that TR-24 may be deemed
inadequate and may be denied on January 8, 2001 unless the following adequacy review
items are addressed to the satisfaction of the DMG.
The requested modification to the PMLU for the 7.44 acre area represents a change in the
permit which does not have more than a minor effect upon the approved reclamation plan
and therefore, pursuant to Rule 1 .1 (54), appears to be appropriately reviewed as a
technical revision. However, the request for release of the 7.44 acre area from
reclamation liability must be submitted in accordance with Rule 4.16 and cannot be
approved through the technical revision process. Should SGC desire to reduce the
permitted acreage, as indicated in TR-24, please submit a request for acreage reduction
which satisfies the requirements of Rule 4.16.
By January 8, 2001 , please submit a written statement to TR-24, clarifying that the
request for acreage reduction is withdrawn from TR-24.
Please contact me at the DMG Durango Office, 701 Camino del Rio, Room 125, Durango,
CO 81301 , phone (970) 247-5469, if you have any questions.
Sincerely,
Wallace H.
