In May of 1976 the State of Colorado enacted House Bill 1056, here- <br /> after referred to as the Mined Land Reclamation Act of 1976. Under <br /> this statute, all mining operations subject to the provisions of the <br /> Act operating within the boundaries of the State of Colorado are re- <br /> quired to submit to the regulatory office (Mined Land Reclamation) a <br /> mining permit application for one of the following designations de- <br /> scribing the mining operation: (1) Regular operation; (2) Limited <br /> Impact operation; (3) Prospecting operation. The application designa- <br /> tion is determined by the amount of surface acreage disturbed by the <br /> operation. The mining permit application, regardless of designation, <br /> is required to include a reclamation plan, addressing primarily the <br /> methods and materials to be employed to restore lands disturbed by <br /> mining and related activities to a state congruent with pre-existent <br /> or surrounding land use policies. <br /> On October 1, 1977, Standard Metals Corporation submitted to the Mined <br /> Land Reclamation Office a permit application for regular mining opera- <br /> tions under Rule 2 of the Mined Land Reclamation Act of 1976. On Janu- <br /> ary 25, 1978, Standard Metals' permit application for regular mining <br /> and milling operations at the Sunnyside Mine and Mayflower Mill was <br /> approved by the Mined Land Reclamation Board. Continued compliance with <br /> the regulations of this permit requires that an annual report addressing <br /> the progress of the reclamation plan be submitted to the Mined Land Re- <br /> clamation Office on the anniversary date of each permit year, section <br /> 2.41 under Rule 2.
